- BOOKING CONDITIONS -
All bookings (including those made via our website, by telephone, fax or email) are subject to these Booking Conditions.
1. Except where otherwise specified, we, Hotel Promotion Services Limited (“HPS”) of Archgate, 823 – 825 High Road, North Finchley, London N12 8UB act only as an agent in respect of all bookings we take and/or make on your behalf. We accept no liability in relation to any contract you enter into or for any services or arrangements you purchase through us (“arrangements”) or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any arrangements. For all arrangements, your contract will be with the supplier of the arrangements. Please note the supplier may not necessarily be the hotel proprietor.
2. The terms and conditions of the supplier(s) of your confirmed arrangements will also apply to your booking. These terms and conditions may limit and/or exclude the supplier's liability to you.
3. HPS is not a Tour Operator and does not provide packages within the meaning of The Package Travel, Package Holidays and Package Tours Regulations 1992. HPS functions as an agent on behalf of the accommodation provider and is paid a commission for the service of introducing and collecting monies for the provider.l
4. All arrangements featured or referred to are at all times prior to specific confirmation subject to availability and no warranties, promises or representations are given as to availability.
5. Our website and our brochure and the information contained in them are not offers by us to sell any arrangements, but an invitation to you to make an offer to our suppliers. We are free to accept that offer on behalf of those suppliers or to reject it. Your contract with the supplier concerned will be confirmed when we dispatch your confirmation invoice to you.
6. Unless you tell us otherwise, we are entitled to assume that all members of your party are British citizens who hold or will hold full British passports valid for the entire duration of the arrangements you chose to purchase. Information on visa, passport and health requirements, where given and applicable, is so given on this basis. Requirements may change and you are therefore strongly recommended to check the up to date position with the supplier of the arrangements, Passport Office, appropriate embassy or consulate or your doctor as applicable in good time before departure.
7. Information on health is contained in the Department of Health leaflet T6 (Health Advice for Travellers) available from your local Department of Health office and most Post Offices. For holidays in the EEA you should obtain an EHIC (European Health Insurance Card) prior to departure.
8. It is the party leader’s responsibility to ensure that all members of the party are in possession of all necessary travel and health documents before departure. All costs incurred in obtaining such documentation must be paid by you. We regret we cannot accept any liability if you or any member of your party are refused entry onto any transport or into any country due to failure on your part to carry correct documentation.
9. If you need to cancel or amend a confirmed booking, cancellation/amendment charges will generally be payable. The amount of such charges varies according to the time your notice of cancellation is received by the supplier concerned before departure but please note these generally increase the closer to the date of your stay that you cancel and may be as much as 100% of the total cost of the booking. Discounts or refunds will generally not be made if clients are delayed or fail to arrive at their destination or use services they have already booked and paid for regardless of the reason, including illness or transport difficulties.
Please note if you wish to try to cancel or amend your booking you must do so through us. Our offices are open 9.00am – 17.00 Monday to Friday. Cancellations made direct with the hotel at which you are staying will not be effective against any applicable cancellation charges you may be required to pay.
10. You are strongly recommended to take out personal travel insurance for all members of your party to cover amongst other things the risk of cancellation and the cost of assistance, including repatriation, in the event of illness or accident. Some suppliers require that you do so. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details on receipt and take them with you on holiday. Insurance premiums are not usually refundable and all facts relevant must be communicated to Insurers. Premiums must be paid as soon as possible as cover will not be effective until all applicable premiums are paid in full.
11. If there is a change or cancellation to your booking we will pass on the new details to you together with any compensation and/or refund that the supplier may offer. As agent only for the supplier, we cannot accept any liability for any changes or cancellations made to these bookings. We may be able to assist you to book alternative arrangements and/or in resolving any complaint regarding your arrangements and/or providing you with special invoices, but this may be conditional on your paying in advance a reasonable administration charge. Please also see clause 17.
12. When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. All clients are expected to have consideration for other people. If in our reasonable opinion or that of any person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party (including our staff) or damage to property, we or the supplier of the service in question are entitled, without prior notice, to terminate the stay of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation. We and the supplier will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we and the supplier will not pay any expenses or costs incurred as a result of the termination.
13. You are responsible for all extras charged by suppliers including all surcharges and taxes. You must not without the previous consent of the supplier concerned assign, sub-let or exchange any accommodation or services booked with them or allow the number (or ages) of persons named on the booking to be exceeded.
14. Payment for reservations is due in UK pounds sterling and any necessary conversions will be shown on Accounts with the date applicable. If a refund or a discount is allowed by the supplier this will be similarly payable on the date when due as stated thereon. Refunds will be calculated at the date payable and HPS reserves the right to make administrative charges in such cases.
15. In paying by debit or credit card you promise that have the authority of the card owner to use that card and that there are sufficient funds to cover the cost of the arrangements you are booking.
16. The description of accommodation, facilities and/or services supplied by suppliers and appearing on our website and in our brochures and marketing literature is provided to us by and is the sole responsibility of the supplier. We cannot warrant the accuracy of such descriptions and cannot accept any liability for any errors or inaccuracies in any such descriptions except where such errors or inaccuracies were due to our negligence or that of any of our employees providing they were acting within the course of their employment at the time.
17. If you have any complaints concerning any agency services we provide, you must inform us straight away in writing and in any event within 28 days of the end of any arrangements booked through us. We regret we cannot accept any liability if we are not so notified. Our maximum liability to you if we are found to have been at fault in relation to any service we provide (as opposed to any service provided by any third party such as an accommodation owner for whom we are not responsible) is limited to the commission we have earned or are due to earn in relation to the booking in question. [We do not exclude or limit any liability for death or personal injury which arises as a result of our negligence or that our employees whilst acting in the course of their employment.
If you are dissatisfied with rooms, facilities and/or services or any other arrangements you must complain to the supplier and the on site management immediately in order to give the supplier and the on site management an opportunity to resolve the issue as soon as possible. NB Any assistance we may give you in resolving a complaint is given in our capacity as agent only.
18. We reserve the right to increase or decrease the price of unsold arrangements at any time. As we act only as agent for the supplier concerned, we also reserve the right, except where we have already received the original full cost of your arrangements from you, to pass on to you in full after bookings have been confirmed all additional costs and charges of whatever nature imposed by the supplier in accordance with its own terms and conditions and to pass on any charges resulting from any change in any applicable taxes or exchange rates. We also reserve the right to correct errors in both advertised and confirmed prices. We will do so as soon as we become aware of the error. Please note, changes and errors occasionally occur. You must check the price of your chosen arrangements at the time of booking.
19. Our website may contain links to other websites on which for example you may book other arrangements such as car hire, insurance, airport parking, travel insurance, and flights etc. Except where they belong to us, such other websites are not under our control or maintained by us. We cannot accept any liability whatsoever and howsoever arising in relation to any arrangements which you may book through those sites or any information or other material appearing on them. Those arrangements do not form any part of the arrangements which you book through us. If you book any of the arrangements on those other sites you will have a separate contract with the provider of those arrangements. The conditions of that provider will apply to that contract
20. We both agree that English Law (and no other) will apply to your agreement with us and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both also agree that any dispute, claim or other matter of any description or by the Courts of England and Wales only unless, in the case of Court proceedings, you live in Scotland or Northern Ireland. In this case, proceedings must either be brought in the Courts of your home country or those of England and Wales. If proceedings are brought in Scotland or Northern Ireland, you may choose to have your contract and any dispute, claim or other matter of any description which arises between us governed by the law of Scotland/Northern Ireland as applicable (but if you do not so choose, English law will apply).
